Terms & Conditions for Design & Build Services

  1. Scope of Work

PMJ (the “Company”) will provide design and build services as outlined in the signed proposal or agreement. This includes conceptual design, space planning, 3D rendering, construction, and project management unless otherwise stated.

  1. Design Development
  • All designs presented are the intellectual property of PMJ.
  • Revisions are limited to [2] rounds unless otherwise stated.
  1. Approvals & Permits
  • PMJ will assist in the submission of plans to local authorities if required.
  • The client is responsible for all permit and approval fees unless otherwise stated.
  1. Payments & Fees
  • A deposit of 【10-50%】 is required upon signing the contract to secure the project.
  • Progress payments will be made according to the project milestones listed in the payment schedule.
  • Final payment is due upon project completion or as otherwise agreed.
  1. Delays & Extensions
  • PMJ is not liable for delays due to force majeure, changes in scope, late client decisions, or third-party contractors.
  • Extension of time will be granted where applicable.
  1. Changes & Variations
  • Any changes to the approved design or scope must be documented via a Variation Order.
  • Additional costs arising from such changes will be billed accordingly.
  1. Warranty
  • A [12-month] workmanship warranty is provided from the date of project completion.
  • This does not cover damages due to misuse, accidents, wear and tear, or third-party works.
  1. Site Access
  • The client must ensure access to the site during agreed working hours.
  • PMJ will not be held responsible for delays caused by restricted access.
  1. Liability
  • PMJ will not be held liable for damages or delays caused by materials or fittings supplied by the client.
  • Any damages caused by our team will be rectified at our cost.
  1. Termination
  • Either party may terminate this agreement with [14] days’ written notice.
  • All completed works and materials up to the termination date will be billed accordingly.
  • The deposit is non-refundable once design work has commenced.
  1. Confidentiality

All design concepts, pricing, and project details are to remain confidential between the client and PMJ.

  1. Governing Law

This agreement shall be governed by the laws of Malaysia. Disputes shall be resolved through mediation or arbitration before legal action.
